General terms and conditions of business
of Bergbahnpool Montafon Brandnertal OG, its shareholders and partner companies
(hereinafter also referred to as "contractual partner")
a) These General Terms and (GTC) apply between the contractual partner and the purchaser (hereinafter referred to as "customer") of a ticket with the designation "WildPass" (season ticket, annual ticket, multi-day ticket, sun subscription, etc.), with the designation "Ländle Card" or "Kristberg Montafon" or a ticket that exclusively entitles the holder to use the facilities of a mountain railroad (e.g. day tickets, single rides) (hereinafter referred to as "ticket") on the other hand. A ticket entitles the customer to use the cable car and lift facilities, slopes, routes and paths (hereinafter "facilities") of the contractual partner to the extent specified in the tariff regulations for the respective ticket (see homepages of the contractual partners). In the event of a dispute, the contractual partner is obliged to prove the accessibility and effective inclusion of these GTC and the tariff provisions in the contractual relationship.
b) Framework agreement - representative of other mountain railroads The mountain railway companies and their partner companies in whatever legal form (hereinafter referred to as "mountain railroads") that are part of the "WildPass" card association (Silvretta Montafon, Golm Silvretta Lünersee Tourismus, Gargellner Bergbahnen, Kristberg, Brandnertal etc.) as well as other card associations such as the "Ländle Card" or "Kristberg Montafon", operate their respective facilities independently and legally autonomously. When purchasing such a ticket, a framework agreement is concluded and the respective mountain railroad acts as a representative on behalf of these other mountain railroads or, in the case of tickets with the designation "WildPass", on behalf of Bergbahnpool Montafon Brandnertal OG.
c) The specific transportation contract (individual contract) is concluded by the use of the ticket with the respective access systems, but only with the cable car whose facilities the customer is currently using. Any liability arising from the transportation contract (individual contract) towards the customer, or on the basis of other contractual or statutory provisions, for incidents arising from or during the operation and use of the cable car and lift facilities as well as ski slopes and ski routes shall therefore be borne exclusively by the cable car and lift company in whose area the incident occurs. The other cable car companies from other card networks ("WildPass" or "Ländle Card") or the Bergbahnpool Montafon Brandnertal OG are not liable. In particular, there is no liability from the framework agreement. Bergbahnpool Montafon Brandnertal OG does not provide any transportation services.
d) When purchasing tickets that exclusively entitle the holder to use the facilities of a mountain railroad (e.g. day tickets, single rides), the transportation contract is concluded exclusively with this mountain railroad.
e) If tickets are purchased from third parties (third parties include external sales outlets such as Montafon Tourismus and other sales outlets such as Stand Montafon, sports stores, hotels, tourist offices, etc.), these act, depending on the ticket, as representatives for the conclusion of the framework contract or as representatives of the respective mountain railroad for the conclusion of the individual transportation contract.
f) The transportation contract is only concluded for the use of the respective open areas (cable car facilities, pistes, ski routes, etc.) during the announced operating times. Contractual claims against the mountain railroad therefore only exist for the duration of the operating times announced in each case (for the ski area visited by the customer) and only for the open areas.
a) The prerequisite for using the services of the mountain railroads is the purchase of a valid ticket. This entitles the customer to use the respective open areas (cable car facilities, pistes, ski routes, etc.).
b) With the purchase of a winter ticket, the customer acquires the opportunity to use at least 60% of the cable car facilities on at least 70 days in winter.
c) With the purchase of a summer pass, the customer acquires the opportunity to use at least 60% of the summer lifts on at least 70 days in summer.
d) With the purchase of an annual pass, the customer acquires the opportunity to use at least 60% of the cable car facilities or summer lifts on at least 70 days in winter and at least 70 days in summer.
e) The prices announced at the time of purchase apply to the purchase of the ticket.
f) The operating and opening hours of the respective facilities operated by the mountain railroads can be found on the notice board at the ticket office. Customers must plan their trips in such a way that they can be back in the valley or at their starting point in good time before closing time.
g) It is expressly pointed out that maintenance work (e.g. use of snow groomers, cable winches, etc.) is carried out after the end of operating hours and that obstacles (e.g. cables, ropes, hoses, etc.) may lie in the area of the slopes or ski routes and that this can cause great danger.
h) As is generally known and as has been the case every year since the beginning of commercial winter sports in the entire Alpine region, it is not always possible to keep all lifts/slopes of all mountain railroads open at all times. This serves to protect the safety of customers from alpine dangers, for example. It is generally known that such restrictions can occur every year, although a comprehensive range of services is still available in any case.
a) The customer acknowledges that it is his duty to comply with the FIS rules and to behave considerately towards other customers and the employees of the cable cars, in particular not to endanger the physical safety of other persons.
b) The customer must also follow the instructions of the cable car staff, as these serve the safety of the customers and the order of the cable car operation.
c) The ticket and any proof of a discount must be presented at the request of the cable car staff so that it can be checked whether services are being used correctly. Failure to do so may result in the ticket being blocked and transportation being refused.
d) The customer is advised that, in accordance with the provisions of the Vorarlberg Sports Act, piste attendants are entitled to prohibit a winter sports enthusiast from (further) use of the cable car facilities for 24 hours if he/she commits the violations specified in the law or continues to do so despite a warning. The piste attendants are also authorized to confiscate the ski pass or sports equipment from the skier. In such a case, the customer is not entitled to a (pro rata) refund of the cost of the ski pass.
e) Barriers, markings and instructions of the cable car staff serve the safety and order of the operation (e.g. against avalanche danger, protection of forest areas, etc.) as well as the safety of other customers and must therefore be observed in any case.
f) Any use of a ticket in breach of contract and misuse (e.g. use of services without a valid ticket, disregard of the instructions necessary for safe operation, reckless or dangerous behavior despite a warning, use of a discounted ticket without meeting the requirements, transfer of the ticket to third parties for use by them, etc.) will result in its withdrawal. Any remaining days of the validity period of the ticket will not be (proportionately) refunded, replaced or credited. In the event of misuse, the right is reserved to file a complaint, provided the legal requirements are met.
a) Tickets are issued on a contactless data carrier (no deposit card).
b) First and last names, date of birth and a photograph are recorded by means of a digital camera at the time of purchase.
c) This data carrier may not be transferred to third parties for use by them.
a) In the event of serious injury or illness of the customer (which makes it impossible to continue practicing winter sports), the selling mountain railroad will refund a proportion of the ticket costs.
b) For this purpose, the injured/ill customer must present a medical certificate (confirming that winter sports can no longer be practiced for the remaining period of validity) and the ticket must be deposited with the selling mountain railroad.
c) Thereafter, the costs will be refunded pro rata from the last day used on which the ticket could no longer be used due to injury or illness, whereby a processing fee of € 7.50 will be retained. If the medical certificate is handed in at a stationary ticket office, a cash payment will be made; if the certificate is subsequently submitted by e-mail or post, the refund will always be made in the form of a voucher.
d) For accompanying persons, family members, etc. of an injured/ill customer, a (pro rata) refund is not possible under any circumstances.
e) If the ticket or the sports equipment has been taken from a customer by a piste attendant (see above), there is no entitlement to a (pro rata) refund of the cost of the ticket.
f) There are no refunds for day tickets and two-day tickets in the event of serious injury or illness.
a) Compliance with any health-related protective measures prescribed by the authorities for customers of a ski area (e.g. to contain a pandemic) is the sole responsibility of the customer.
b) If a customer is unable or unwilling to comply with the health-related protective measures prescribed by the authorities (e.g. proof of vaccination or a test, wearing a mask, distancing rules, etc.), transportation cannot be provided.
c) In this case, the customer is not entitled to a (pro rata) refund of the cost of their ticket.
a) The contractual partners are responsible within the meaning of the GDPR for the processing of the customer's personal data.
b) The customer's data will only be processed in compliance with international and national data protection regulations.
c) The customer receives the complete data protection information under data protection information
a) In some cases, it is necessary for the acquisition of authorizations and the provision of the contractual services of the mountain railroads that photos are created and stored digitally. The customer gives his consent to this.
b) For all special tariffs and discounts, a corresponding ID (original) must be presented.
c) Own facilities (e.g. halfpipe, pistes, lifts, etc.) may be partially restricted in their usability.
d) The use of the piste rescue service is subject to a charge.
e) All tickets, with the exception of points cards, are not transferable to third parties for use by them.
